Welcome to GoGetzy. These Terms of Service ("Terms") govern your use of the GoGetzy mobile application and related services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Definitions

• "Platform" refers to the GoGetzy mobile application and related services
• "Users" refers to both service seekers and service providers
• "Service Providers" are professionals offering services through the platform
• "Service Seekers" are users requesting services
• "We", "Us", "Our" refers to GoGetzy

2. Acceptance of Terms

By creating an account or using GoGetzy, you:

• Confirm you are at least 18 years old
• Agree to comply with these Terms and all applicable laws
• Agree to our Privacy Policy
• Accept that we may modify these Terms at any time

3. Account Registration

3.1 Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account
• You must verify your phone number via OTP
• One person may only create one account

3.2 Service Provider Verification

Service providers must:

• Complete additional verification including identity documents
• Provide accurate information about qualifications and experience
• Maintain valid licenses/certifications where required by law
• Undergo admin approval before listing services

4. User Conduct

You agree NOT to:

• Violate any laws or regulations
• Provide false, misleading, or fraudulent information
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Post spam, offensive, or inappropriate content
• Interfere with or disrupt the platform's operation
• Attempt to gain unauthorized access to our systems
• Use the platform for any illegal purpose
• Create fake reviews or ratings
• Circumvent or manipulate fees or pricing

5. Platform Services

5.1 Service Matching

GoGetzy provides a platform to connect service seekers with service providers. We:

• Use AI to match requests with appropriate providers
• Facilitate communication between parties
• Provide payment processing capabilities
• Maintain ratings and review systems

5.2 Not a Service Provider

Important: GoGetzy is a technology platform and marketplace. We do not:

• Employ service providers directly
• Provide the services listed on the platform
• Guarantee the quality, safety, or legality of services
• Act as an agent for service providers or seekers

6. Service Provider Obligations

Service providers agree to:

• Provide services professionally and competently
• Honor commitments made through the platform
• Maintain appropriate insurance and licenses
• Comply with all applicable laws and regulations
• Resolve disputes professionally with customers
• Pay applicable platform fees and commissions

7. Payments and Fees

7.1 Service Fees

• Service seekers pay the agreed-upon price to service providers
• Platform fees and commissions apply as per current pricing
• All payments are processed securely through third-party processors

7.2 Refunds and Disputes

• Refund policies are determined by individual service agreements
• Disputes should be resolved directly between parties first
• GoGetzy may mediate disputes but is not obligated to
• Platform fees are generally non-refundable

8. Ratings and Reviews

• Users may rate and review service providers after service completion
• Reviews must be honest, accurate, and based on actual experience
• We reserve the right to remove fraudulent or inappropriate reviews
• Service providers may respond to reviews

9. Intellectual Property

All content, features, and functionality on GoGetzy are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or extract source code from our platform

10. Privacy and Data

Your use of GoGetzy is subject to our Privacy Policy, which explains how we collect, use, and protect your data.

11. Disclaimers and Limitations

11.1 Service Quality

GoGetzy does not guarantee:

• The quality, accuracy, or reliability of services provided by third-party providers
• That service providers are properly licensed or insured
• The availability of services at any particular time
• That the platform will be error-free or uninterrupted

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• GoGetzy is not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees paid by you in the past 12 months
• We are not responsible for fraud, damage, or loss caused by users or service providers, or for service provider actions or failures
• We are not liable for third-party payment processor issues

11.3 "AS IS" Basis

The platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

12. Indemnification

You agree to indemnify and hold GoGetzy harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the platform
• Services you provide or receive through the platform
• Your violation of any third-party rights

13. Termination

13.1 By You

You may terminate your account at any time by contacting support or using in-app account deletion.

13.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Receive multiple negative reports from other users
• Remain inactive for an extended period

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of India.

14.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of courts in Kolkata, West Bengal, India.

14.3 Arbitration

We encourage resolution of disputes through good-faith negotiation. If unresolved, disputes may be subject to arbitration as per Indian Arbitration and Conciliation Act, 1996.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via:

• In-app notification
• Email to your registered address
• Notice on our website

Continued use after changes constitutes acceptance of the updated Terms.
